Free medical-legal advice for malpractice

There is a time limit to sue a negligent doctor, from the date on which the damage was caused or from when it was discovered.

As a general rule, you have 10 years to prescribe damage caused by medical errors and malpractice.

Before taking any action that may compromise your rights or legal obligations, it is always appropriate to consult an expert lawyer.

A lawyer's opinion is useful to be informed about the laws in force and to determine how much time you have available to take legal action before the prescription starts.

According to the norms of the civil code (articles 2935 and 2946), the prescription of the professional responsibility of the doctor begins to run from the day on which the right can be asserted and it ends within ten years from it.

In case of hidden damage, the limitation period begins to run from the moment the damage has been discovered or it should reasonably have been discovered.

The ERMES Association offers an absolutely free consultation with no obligation for the evaluation of the medical damage, for the sole purpose of informing the person concerned about the possibility of requesting an economic reimbursement for medical responsibility.

The client will not have to pay any legal fees until he obtains the reimbursement for damages and the compensation, established at the beginning with an agreement, will be honored at the end of the judicial process, as foreseen by the code of conduct for lawyers.

ERMES protects citizens' rights by providing a highly professional medical-legal advice that is free of charge until the result is achieved.
